CONSENT AND RELEASE OF LIABILITY

    THIS IS A RELEASE OF LEGAL RIGHTS. READ CAREFULLY.
    PLEASE COMPLETE THE FOLLOWING INFORMATION:

    I ACKNOWLEDGE THAT BY SIGNING THIS DOCUMENT, I AM ASSUMING RISKS, AND AGREEING TO INDEMNIFY, NOT TO SUE AND RELEASE FROM LIABILITY THE ORGANIZER OF THIS EVENT, BIKETUR CHILE, AND ITS RESPECTIVE AGENTS, INSURERS, EMPLOYEES, MEMBERS, OFFICERS, DIRECTORS, VOLUNTEERS, EVENT DIRECTORS, AND AFFILIATES (COLLECTIVELY "RELEASEES"), AND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS. THIS RELEASE IS A CONTRACT WITH LEGAL AND BINDING CONSEQUENCES AND IT APPLIES TO ALL ACTIVITIES PARTICIPATED IN AT THE EVENT, REGARDLESS WHETHER OR NOT LISTED ABOVE. I HAVE READ IT CAREFULLY BEFORE SIGNING, AND I UNDERSTAND WHAT IT MEANS AND WHAT I AM AGREEING TO BY SIGNING.

    1. I expressly declare that it is my will to carry out this activity, and I understand that I am responsible for all the risks involved with my participation in the aforementioned Event. I will comply with all rules, regulations, and behavior standards applicable to the Event.

    2. I am legally competent to sign this Release, or my parent or guardian has also read and signed this Release on my behalf.

    3. I ACKNOWLEDGE THAT CYCLING IS AN INHERENTLY DANGEROUS SPORT AND FULLY REALIZE THE DANGERS OF PARTICIPATING IN THIS EVENT, whether as a rider, volunteer, spectator, or otherwise, and FULLY ASSUME THE RISKS ASSOCIATED WITH SUCH PARTICIPATION INCLUDING, by way of example, and not limitation: dangers of collision with pedestrians, vehicles, other riders, and fixed or moving objects; the dangers arising from surface hazards, including pot holes, equipment failure, inadequate safety equipment, use of equipment or materials provided by the Event organizer and others.

    4. I FULLY ASSUME THE RISK OF INJURY, SICKNESS, DAMAGE, LOSS OR DEATH ASSOCIATED WITH SUCH PARTICIPATION INCLUDING, by way of example, and not limitation, the following: THE RELEASED PARTIES’ ORDINARY NEGLIGENCE, heat, humidity, and other weather conditions, including severe storms, tornadoes, lightning, and other weather emergencies; and the possibility of serious physical and/or mental trauma or injury or illness. I understand that while participating in the Event I will be riding my bicycle on public roads which will be open to regular vehicular traffic, and I will be exposed to the hazards involved with sharing the road with such traffic. I will also be sharing the road with many other bicyclists, some of whom may be inexperienced, and understand that this adds a further element of danger. I also acknowledge that I may be exposed to significant risks while engaged in other voluntary activities related to the Event including, without limitation, outdoor camping, dining, swimming, shuttle and ferry transportation. For myself, my spouse, heirs, executors, administrators, legal representatives, assignees, and successors in interest (collectively “successors”).

    5. I declare that I have acquired medical and / or travel insurance that covers such risks, that I comply with the requirements demanded by the policy of the same, and that I have disclosed all the pertinent medical and personal information to my insurance company.

    6. I certify that I am in good mental state and good health, which is adequate and compatible with this event, that I am not under the influence of alcohol, nor under the influence of drugs or narcotic drugs.

    7. I declare that I am being treated with the following medication

    and that I consulted a doctor and I have his approval to participate in this activity, while under the influence of medicine or medications.

    8. I hereby release and disclaim liability, and I waive my right to claim damages against BIKETUR, its agents, volunteers, contractors and persons working in this event. And I also give up on filing claims, lawsuits and / or actions to prosecute responsibilities, costs and expenses of any nature including claims for death, injury, physical injury, disability, property damage, loss or theft, related to my participation in both events regardless of their cause or reason, except in the case of proven negligence of the exempted parties.

    9. This Release shall be binding on me and my legal representatives, heirs and assigns perpetuity. It will be governed by the laws of Chile.

    I HAVE CAREFULLY READ THIS CONSENT AND RELEASE. I FULLY UNDERSTAND ITS CONTENT AND SIGN IT OF MY OWN FREE WILL.

    The parent or legal guardian of the participant named in this Release, if he or she is under the age of majority; OR

    EQUIPMENT AGREEMENT

    PLEASE READ CAREFULLY BEFORE SIGNING:

    I hereby acknowledge and agree to the following rental agreement terms and conditions:

    _Bicycles are rented out clean and in proper working condition and must be returned in the same manner.

    _Helmets are included in the rental and are required to be worn at all times while riding bicycles rented from BikeTur Chile. If a customer is seen riding the rental bicycle without a helmet, they will immediately have to return the bicycle with no refund.

    _Bikes are maintained on a daily basis. It is the responsibility of the client to check the bike at the store BEFORE setting out on any ride.

    Customer agrees to return the bike in clean, UNDAMAGED condition to avoid any ADDITIONAL charges for repair, maintenance or replacement. Customer accepts use of the equipment, AS IS, in good condition and accepts full responsibility for care of the equipment while under his/her possession. Damaged parts or components will be repaired/replaced at the shop’s discretion and customer agrees to pay regular shop rates and retail prices for components replaced as detailed below.

    Clean condition means normal wear and tear is accepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes.

    Customer agrees to provide Biketur Chile with credit card details, for precautionary use only:

    I authorize Biketur Chile to charge the credit card they have on file for me for all eventual costs in case of damages to the bicycle(s) during my rental period, comprehensive of labour, except in the case that I can demonstrate other’s faults with evidence and all necessary information for reimbursement. In case of theft, I will be responsible for reimbursing Biketur Chile for the original price of the bicycle(s), plus the cost of any accessories that were provided at the time of the bike rental.

    I have carefully read and understand the above. I understand this is an assumption of risk, waiver and release of liability and I sign it voluntarily. I also understand that I should not and may not participate in this activity if I am under the influence or alcohol or drugs.

    OPTIONAL AUTHORIZATION FOR THE USE OF IMAGE AND AUDIOVISUAL MATERIAL

    At BIKETUR CHILE, we love capturing the best moments of your ride so you can keep and share memories from your experience.
    At the end of your activity, we will share with you the photos and videos taken during your ride.
    We kindly ask for your authorization to use these photos and videos on our website, social media, and promotional materials to inspire more people to enjoy mountain biking and nature.
